A Legal Update You Need to Read

We wanted to share some details regarding a recent court decision in Texas. 


The court ruled that the Terms of Service language available on a website cannot apply to users retroactively — only when the user accessed the website. 


So, what does this mean? Even if you hire an attorney and add a robust terms and conditions statement to your website this month, it does not protect you from what has already happened. 


To strengthen your statement, you might consider adding language like this to your terms and conditions on your website: "Your use of this website will be conditioned upon the terms and conditions in force at the time of your use." 



This issue is specific to Texas, but it won't hurt to consider protecting your firm by reviewing your current wording. We can't give legal advice, but we can advise you to have a conversation with your legal counsel!
